Remediation of landfills and contaminated sites
The most recent laws and regulations impose and dictate the operating procedures for the execution of remediation, with the entry into force of "decree no. 152 of 3 April 2006, concerning the new disciplines regarding the remediation of contaminated sites and the previous decree of the Ministerial Decree of 25 October 1999, no. 471, article 17 of Legislative Decree 22/1997 "Ronchi Decree" containing the rules regarding the remediation of contaminated sites has been fully implemented. The general principle, provided for by Article 17 of the “Ronchi Decree” and taken up by Article 7 of Ministerial Decree 147/1999, is that anyone who causes, even accidentally, the exceeding of the accessibility limit values set out in Annex 1 to Ministerial Decree 471/1999 or determines the concrete and current danger thereof, must provide for the implementation of emergency safety, remediation and environmental restoration interventions to eliminate pollution. This means that the obligation to remediate is triggered not only automatically as a consequence of unlawful acts, but also obligatorily even after an accident, “even accidentally”, when it is not possible to configure a wilful or negligent liability on the part of the person responsible.
This is the hypothesis provided for by article 7 of Ministerial Decree 471/1999 and which is embodied in the immediate obligation to notify the competent authorities, by the person responsible for the pollution, of the limits having been exceeded.
